This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products listed on France Medicals’ (Our) website at www.e-one.com.au to you. Please read these terms and conditions carefully before ordering any Products from our website. You should understand that by ordering any of our Products, you agree to be bound by France Medical’s Terms and Conditions/Contract.
You should print a copy of these terms and conditions for future reference, as this is an agreement between yourself and France Medical.
Please click on the button marked “I Accept” at the end of these terms and conditions if you accept them. Please understand that if you refuse to accept these terms and conditions, you will not be able to order any Products from our website.
If you buy your E-One when the Satisfaction Guarantee offer is available on our website and after 6 months you are not satisfied, for whatever reason, if you return it to us within 15 days after the 6 month period France Medical (We) will give you a full refund (less postage, packaging and consumables (used and unused) fees: including gel, cartridge, mobile head, red filter, white pencil, set of patches, cleaning spray, guide plate and safety glasses).
How to Claim your Money Back:
If you find that you are not satisfied with your new E-One after six months of use, please fill in the claim form on our website. The form can be found in the “client area” section of the website. To take advantage of this offer your E-One must be returned with the purchase invoice, original packaging and all accessories. All items are to be returned within 15 days after the 6 month period at the customer’s cost and risk.
Terms and Conditions:
To take advantage of the satisfaction guarantee offer you must purchase your E-One when the Satisfaction Guarantee/Money Back Guarantee is available on our website.
The Money Back Guarantee only applies for customers who have purchased upfront (using option 1) or have paid all due payments on time (using option 2).
The Satisfaction Guarantee /Money Back Guarantee period starts midnight on the date of purchase (“Start Date”) and will end at 17:00AEST on the 180th day following purchase. The return of purchase window will expire exactly 15 days after this (Expiry Date).
You must return your E-One after the Start Date and before the Expiry Date.
All returns must be made by either TNT or Hunter Express or Registered Post.
The satisfaction guarantee only applies to products that are returned undamaged and in their original packaging, with all the original accessories.
Only one claim per person and per family.
All refunds will be fulfilled by bank transfer within 30 days of goods being received.
France Medical will not accept responsibility for claims lost, delayed or damaged in the post.
All claims must be accompanied by an original purchase invoice.
This website is operated by France Medical Pty Ltd. We are registered in Australia under ABN 80 160 197 491 with our registered main trading address at 1/161 Robertson Street, Fortitude Valley, 4006, QLD.
Our Products are intended to be used in the home, for non-clinical hair removal. In particular the E-One is a Medical Hair Removal Device for progressive, permanent hair reduction, available for personal use at home and NOT for commercial purposes. Please note that France Medical monitors the use of all E-Ones sold in Australia and New Zealand and reserves the right to refuse the sale of the E-One and its accessories where commercial use is suspected.
Our website is only intended for use by people who reside within Australia and New Zealand. We do not accept orders from individuals outside these countries.
By placing an order through our site, you warrant that:
(a) You are at least 18 years old;
(b) You are legally capable of entering into a binding contract;
(c) You are a resident of either Australia or New Zealand;
(d) You are accessing the E-One site from one of the above countries.
After placing an order, you will receive an e-mail from us acknowledging that we have received your order. This however does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product.
All orders are subject to acceptance by France Medical, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product has been dispatched (Dispatch Confirmation).
The contract between France Medical and yourself, the customer, will only be formed when we send you the Dispatch Confirmation email.
5.1 Please note that in some cases, we accept orders as agents on behalf of third party sellers. The resulting legal contract is between you and that third party seller, and is subject to the terms and conditions of that third party seller, which they will advise you of directly. You should carefully review their terms and conditions applying to the transaction.
5.2 We may also provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking, that products you purchase from third party sellers through our site, or from companies to whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are DISCLAIMED by us absolutely. This DISCLAIMER does not affect your statutory rights against the third party seller. We will notify you when a third party is involved in a transaction, and we may disclose your customer information related to that transaction to the third party seller.
If you are contracting as a consumer, you may cancel a Contract at any time within seven working days, from the time of purchase. In this case, you will receive a full refund of the price paid for the Products.
To cancel a Contract, you must inform France Medical in writing. You must also return the Product(s) immediately, in the same condition in which you received them, and at your own cost and risk with all documentations. All packaging must be intact and complete. You have a legal obligation to take reasonable care of the Product(s) while they are in your possession. If you fail to comply with this obligation, France Medical has the right to take action against you for compensation.
If for any reason a customer chooses to return any product to France Medical, there is a seven-day cooling-off period from time of purchase, or first payment (option 2). France Medical will refund the price of the Product in full, not including the invoiced freight price.
The content on our website (www.e-one.com.au) is for your general information and use. France Medical will use all reasonable endeavours to ensure the accuracy of the content. However, France Medical cannot guarantee or warrant the accuracy or completeness, availability or reliability of any Content on the website and cannot accept any liability for any errors or omissions in the Content. In addition to your consumer right to cancel (above). Please note that if you are purchasing as a consumer and a product ordered by you does not conform to the specification provided on the website (www.e-one.com.au) you may return the product to us at your cost within a period of 7 days from the time of purchase, to receive a refund not including the postage and handling.
Your order should be fulfilled by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within a reasonable time from the date of the Dispatch Confirmation (within 60 days), unless there are exceptional circumstances. In the event a product is no longer available we will let you know as soon as reasonably practicable (10 business days). Please read the Shipping Terms for details of how your product(s) will be delivered.
Ownership of the product(s) will only pass to you when France Medical receives full payment of all sums due in respect of the product(s), including delivery charges. If for any reason a customer does not complete payments on time or breaks the Terms and Agreements (Contract), France Medical has the right to proceed with legal proceedings, debt collection or repossession.
The product(s) will be at the customers risk from the time of dispatch (See Shipping Terms) including when title/ownership belongs to France Medical.
The price of any product(s) will be as quoted on our website (www.e-one.com.au) and are subject to change by France Medical.
These prices include GST but exclude delivery costs, which will be added to the total amount due as set out in our Order Confirmation page.
Prices are liable to change at any time. Any changes will not affect orders that have already been confirmed via the e-mailed confirmation.
The France Medical website contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. France Medical will verify prices as part of our dispatch procedures where needed. When a product(s) correct price is less than our stated price, we will charge the lower amount when dispatching the product(s) to you. If a product(s) correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the product(s), or reject your order and notify you of such rejection.
France Medical is under no obligation to provide the product to you at the incorrect (lower) price, even after a customer may have received a Dispatch Confirmation. It is at the discretion of France Medical to choose to ignore such an event as a mistake in price, obvious mix up or pricing error.
Payment for all products must be made by Credit or Debit Card and Direct Debit Transaction through our secure online payment facility which goes through France Medical PayWay Westpac merchant gateway. We may also accept payment details by telephone (telephone payments are made to France Medical staff). Please note that your order will be charged in Australian dollars (AUD$). The currency conversion is to be used as a pricing guide only. The actual amount you will be charged will be the Australian dollar (AUD$) amount and converted by your card provider at the exchange rate at the time the payment is processed. Please note your Credit Card provider may charge you an additional conversion fee as well. We do not ship to Post Office boxes or alternate addresses outside of Australia.
France Medical warrants you that any product(s) purchased from France Medical through this website (www.e-one.com.au) at the date of dispatch to you, are of satisfactory quality and reasonably fit for the purposes set out on our website. As otherwise required by law no other warranties are given in respect of the Product(s) and you should check our website to ensure that the Product(s) are appropriate for your intended use.
In the event that the Product(s) delivered does not comply with the product information contained on our website, please return the Product(s) within 7 working days (the Cooling Off period) specifying the reason why you are returning it, for reference for France Medical (Nothing in this clause affects any consumer rights you may have as a customer).
All returns are to be made at the your cost.
Our after sales service is the only authorized provider of repair services for the products under warranty. Where goods are defective, France Medical shall not be responsible for taking back a Product that has been repaired or modified by any other persons.
The warranty above does not apply to any Accessories. Nor does it apply in the case of defects and deterioration resulting from external events, accidents, electrical faults, wear and tear, installation or use other than in accordance with the instructions provided with the Product. Any product that is modified, repaired, integrated or added by the customer or any other unauthorized person is excluded from the warranty.
Note that the E-One is intended for personal use at home only and no warranty is given in respect of devices used for commercial purposes. To the maximum extent permissible by law France Medical disclaims liability for use of the E-One product(s) for commercial purposes.
Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product(s) you purchase.
This does not exclude or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) For fraud or fraudulent misrepresentation; or
(c) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
We are not responsible for indirect losses (i.e. losses that are not foreseeable by you and us) including but not limited to:
(a) loss of income or revenue
(b) loss of business
(c) loss of profits or contracts
(d) loss of anticipated savings
(e) loss of data, or
(f) waste of management or office time;
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This will not limit France Medical from only using electronic means of communication. These conditions do not affect your consumer rights.
All notices given by you to us must be given to France Medical, 1/161 Robertson Street, Fortitude Valley, 4006, QLD We may give notice to you at either the e-mail or postal address you provide to us when placing an order.
The contract between you and us is binding on you and us and on our respective successors and assigns.
You may not transfer, assign, charge, ignore or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.
France Medical may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) Strikes, lock-outs or other industrial action.
(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
(e) Impossibility of the use of public or private telecommunications networks.
(f) The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
The copyright, trademarks, domain names and other intellectual property rights (“Intellectual Property Rights”) in all material and information on our website (“the Content”) belongs to us or (if it has been licensed to us) to the licensor. All rights are reserved.
You may download or print off copies of the Content of this Site for your personal, non commercial use and information only but, any copying or adaptation of the Content, layout or code of this website, or the creation of an archive or database containing the Content (in whole or part), for any business purpose or other commercial exploitation, without our specific consent will constitute copyright and/or Trade Mark infringement.

If France Medical fails, at any time during the Term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these Terms and Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
A waiver by us of any default shall not constitute a waiver of any subsequent default.
No waiver by us of any of these Terms and Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clauses above.
If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these terms and conditions.
We have the right to revise and amend these terms and conditions from time to time, where France Medical sees fit.
You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).
Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by Australian law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of Australia.
At France Medical, we are committed to protecting your privacy while you visit our website and use our products and services. You can travel throughout most of our website without giving us any information about yourself. Sometimes we may ask you for information so that we can provide a service you request (such as subscribing to a newsletter, free trial or purchasing products). This privacy statement explains how we protect your privacy and our collection and use of the information you provide us with.
We will ask you when we require personal information from you. No personally identifying information will be gathered about you without your consent. When you supply us with information, it may be stored in a database or other storage medium. You can change or remove the information we hold about you by logging in to the Client Area and editing this information or by contacting us.
No details of your credit card number will be recorded in our database and all transactions requiring credit card information will be passed through our secure gateway and will only be handled by our bank in order to process any online purchases you may make with us.
We will not disclose your information to third parties without your consent except to the extent that we have hired a company to act on our behalf to provide a postal, product ordering or support service including and not limiting France Medical to: deabt recovery, repossession, etc. In this situation, we will only provide those companies with the information they need in order to deliver the service.
We will only disclose your personal information to a third party if required to do so by law or in the belief that such action is necessary to either (a) defend the rights, interests or property of France Medical or (b) protect the personal safety of users of our website, users of our products/services or the public.
We will not use the information you provide us with to communicate with you except if we are required to do, in order to fulfil any obligation we have to you as a customer, or under the following four circumstances 1) where the purpose of you providing us with that information was for us to contact you; 2) you purchased one of our products at which stage you may receive confirmation emails after your purchase to confirm your order and provide you with information about your purchase; 3) in the event that we believe there was a problem with an order, whether completed or pending; or 4) if we discover an urgent technical issue related to the product you purchased and we deem it necessary to contact you.
